Ik stuurde vanavond een e-mail naar de CEO over de nieuwe rechtszaak die het waterdistrict aanspant tegen de stad Tehachapi om ditmaal het ‘housing element’ in Tehachapi pogen te vernietigen.
Het housing element bevat de uitwerking van woningprojecten tot en met 2031. Onlangs werd het het waterdistrict geweigerd om hun nieuwe bezwaar toe te voegen aan de huidige, lopende zaak tussen de stad en het district met Sage Ranch als betrokken partij.
CEQA is de wetgeving rond het inschatten van milieu-effecten. In California, waar water schaars is, wordt dit vaak aangegrepen om nieuwe projecten tegen te houden of sterk te vertragen.
Onlangs werden er twee bills toegevoegd om dat wat te counteren (AB 130 en SB 131), net omdat betaalbaar wonen er ook (heel) schaars is.

It seems that the Tehachapi-Cummings County Water District (TCCWD) will be challenging the CEQA exemptions for the City’s state-mandated new housing element simply because they have the option to do so.
I’ve read that the recent Assembly Bill 130 and Senate Bill 131 — which were adopted to strongly reduce CEQA obstacles — provide a statutory CEQA exemption for qualifying infill housing projects up to 20 acres in size within incorporated cities or urban areas.
So, could it be that the housing element cannot be contested if only Phase 1 of Sage Ranch is considered for now? Or will the entire project still be required to undergo a new and full CEQA review?
Also, are there any updates on Sage Ranch or Montalva?

The Water District challenging the Housing Element was denied by the judge to be part of Sage Ranch. It is a new seperate case involving only the Water District and the City. It really has no effect, because the State of California approved the housing Element for the City. The water district will now have to sue the State of California, which is a dead end. The judge also told the District that their 4th cause does not have a chance.
You are seeing the District begin its losing process and suing with abstract law suits is a sign of weakness, not strength.
The Sage Ranch case that is specific to Sage Ranch was adjudicated last June 18. The District cannot sue again on the same case. The city just needs to rewrite the water report.
These other cases have nothing to do with Sage Ranch.
Sage Ranch is going through the city process of the new water report and new city approvals as requested by the judge. We should have the final approval to break ground within 6 minths.
Montalva is working on another price increase.
